The Looting of America

                                                            Federal Reserve Chairman Ben Bernanke

     Schools are being closed, and other government services and human needs programs are being eliminated or reduced all over the country due to budget cuts. The Social Security surplus is disappearing fast in the economic downturn.

    The public treasury is being plundered for the benefit of the very bankers and speculators who are responsible for the financial crash. Further bailout measures are being drawn up in the closest consultation with the Wall Street insiders who stand to profit from them.

    The Federal Deposit Insurance Corporation (FDIC) was established 76 years ago, in the depths of the Great Depression, to provide a government guarantee, initially up to $5,000 and now up to $250,000, on the bank deposits of small savers. Now the FDIC is being transformed to guaranteeing the investments of multimillionaire investment fund managers. And, this is occurring without even a vote by Congress.

     It's worth repeating: Obama needs to fire his Wall St. cronies -- chief financial advisor, Larry Summers, Treasury Secretary Timothy Geithner, Federal Reserve Chairman Ben Bernanke, etc, all those who helped create the financial crisis in the first place.   Instead of bailing out the banks, put up money to guarantee everyone a job or income and stop foreclosures and evictions.

     DO THE MATH: Just $1 trillion out of the $12 trillion Washington has committed to the banks could pay for 20 million jobs with salaries of $50,000 a year! That would wipe out unemployment and underemployment in Hawaii and the U.S. $l2 trillion could pay for pensions for millions of working senior citizens, open up new jobs for younger workers, pay-off defaulting home mortgages, and purchase lots of solar electric home systems and fuel efficient vehicles and mass transit.

     The important question is -- where do you put the money? At the top where the economic problems were created, or at the bottom to really help people in need and the economy.

Simple Solution To Bailout!

The Business Section in The St. Petersburg Times, Florida, Newspaper asked readers for ideas on "how to fix the economy". I thought that this was the best one. This guy was right on.

Dear Mr. President,
Patriotic Retirement: There are about forty million people over fifty years of age in the work force in the U.S. Give each one of them one million dollars severance pay with these stipulations. (For smaller numbers shift the age to 60)

     #1. They leave their jobs.
     BINGO!! Forty million new jobs.
     Unemployment fixed.

     #2 They buy a new American made automobile.
     BINGO!! Again - Auto industry fixed.

     #3 They buy a new home or pay off their mortgage.
     BINGO!!! Again- Housing crisis fixed.

     Like I have been saying, they are bailing out the wrong people.

End the Ways of Empire!
Cut the military & prison budgets!

The military and prison industrial complexes are two sides of the same coin of empire. In fiscal year 2009 the U.S. will spend $965 billion for the military (more than the next l5 countries combined.) A similar exorbitant amount is spent on prisons when local, state and federal expenditures are tallied. The U.S. has more than 2 million people behind bars. That's more people per capita than any country on earth. Our tax dollars are continuing to fuel war and occupation abroad and increasing repression at home. We need to end the ways of empire and establish consistent domestic and foreign policies of peace and justice. We need to stop the wars and end the occupations of Iraq, Afghanistan, and the Kingdom of Hawaii too. We need to change priorities away from bailing out Wall St. bankers. We need to feed the hungry, shelter the homeless, and fund constructive alternatives to prison. We need universal health care, jobs, income, and education for all.

I oppose resolution 098. I support the Clean Elections pilot program for Hawaii County. We need to get special interest money out of elections and level the playing field. The project is legal, has worked well in other places like Arizona and will enable more people to run for office, giving a fresh spirit to the democratic process.

GOOD FRIDAY
Modern Day Crucifixion -- Launching the Drone Wars from Hawaii to Pakistan

    Today is Good Friday in the Christian calendar, the day Jesus was executed by the Roman Empire for the crime of sedition (stirring up the people) in occupied Palestine. One's standpoint determines one's viewpoint. From Jesus' standpoint, and all those nailed to the cross of empire, there was nothing good about "Good Friday." For the Roman Empire and their local collaborators, it was "Good Friday" indeed. They got rid of another troublemaker, or so they thought.

     The Romans, like all empires, believed in a myth -- that violence was a solution to problems. Jesus knew otherwise -- that being willing to die, but not to kill, is the way to new life, justice and peace. His witness proved that the blood of martyrs is the seed of a new movement of non-violent resistance, what others call -- the church. For over 200 years to be a member of this new church meant you refused to participate in the wars of empire. Thousands were crucified for their refusal and the church grew by leaps and bounds.

      What of us today in the American Empire, after six years of war and occupation in Iraq, eight years of war and occupation in Afghanistan, and ll6 years of occupation of the Kingdom of Hawaii? The silence of "the church" today in Hawaii is deafening? Where are the voices of conscience in our local churches today speaking out for justice and peace and against war and occupation? How many Christians are refusing to participate in the wars of empire? How many churches are actively supporting the empire's wars?

     In 2 days of testimony this week about the militarization and desecration of the sacred temple of Mauna Kea, there wasn't one church leader (Christian, Buddhist, or otherwise) who spoke in solidarity with Hawaii's host people, the Kanaka Maoli calling out for justice and respect, and a halt to development on the mountain.   The military has plans for a Pan Stars telescope on Mauna Kea for tracking "enemy" satellites to be destroyed in U.S. pre-emptive wars. A new billion dollar 30-meter telescope is also in the works. Kihei Soli Niheu says that the desecration on Mauna Kea is part of the ongoing illegal occupation of the Kingdom of Hawaii that must end.

     Increasingly, the sacred mountains of both Mauna Kea and Mauna Loa are being militarized by expanded military live-fire training at Pohakuloa, including Unmanned Aerial Vehicles (UAVs) otherwise known as drone airplanes. U.S. hunter-killer drones (MQ-1 Predators and more advanced MQ-9 Reapers) are now being used widely as surveillance and missile-firing aircraft in Iraq, Afghanistan and Pakistan. U.S. Centcom commander General David Petraeus calls this drone form of modern crucifixion "the right of last resort" to take out "threats" (as well as innocent people who just happen to be in the vicinity). Large numbers of innocent people are now fleeing their homes due to U.S. drone attacks in Central Asia.

Good Friday is a good day to break the silence

Re: University of Hawaii Mauna Kea Comprehensive management Plan (CMP)

Aloha Kakou,
Mahalo for coming to Hilo for this hearing.

     My name is Jim Albertini. I'm president of a non-profit peace farm Malu Aina in Kurtistown, that grows food to share with people in need and to support work for justice, peace and preserving the environment.
I'm here today to stand in solidarity with grassroots Kanaka Maoli in opposition to this Comprehensive management Plan which is really a development plan for more observatories in disguise

     I want to start with a short story of my first trip to the summit of Mauna Kea many years ago before I became aware of the controversy over development on the mountain.

     On my first trip to the summit of Mauna Kea, I took with me three visiting friends. All were Roman Catholic priests. One from Italy, one from the the Philippines , and one from the U.S. We wanted to go to the mountain to pray for justice and peace in the world. Given our shared Judeo/Christian roots, all 4 of us were well aware of the the words of the prophet Isaiah Chapter 2: verse 2-4 which translates. "In the days to come, Ke Akua's hale shall be established on the highest mountain... All nations shall stream toward it; many peoples will say: "Come, let us climb Ke Akua's mountain to the hale of Ke Akua, that Ke Akua may instruct us in his ways, and we may walk in his paths...   Ke Akua shall judge between the nations and impose terms on many peoples. They shall beat their swords into plowshares and their spears into pruning hooks; One nation shall not raise the sword against another, nor shall they train for war again."

     That day many years ago, when we got to the mountain top, to the hale of Ke Akua, we found the vista blocked by observatories and what we saw all around was construction debris though no construction was going on. In the distance we could hear the bombing at Pohakuloa. We offered prayers for justice and peace, stood in awe, placed ho'okupu at the Hawaiian ahu and then started our decent. After a time of quiet reflection, ne priest after another shared thoughts of the mountain. How special it was to come there. But there was a shared concern how science had dominated the very mountaintop instead of staying down a few hundred feet from the summit out of respect. The construction debris left also spoke of a disrespect to spiritual values, especially those of the host culture, the Kanaka Maoli. The military's bombing of Mauna Kea and Mauna Loa below at Pohakuloa is another example of profound disrespect. Now the military's plan for a Pan Stars telescope on Mauna Kea is a further militarization of the mountain by tracking satellites to be destroyed as part of U.S. first-strike pre-emptive nuclear war plans.

     The scripture reading from Isaiah says that Ke Akua's hale should be a place of peace. For peace to be genuine and pono, it must be built on a foundation of justice and respect, especially for the host culture. Where is the justice, when Kanaka Maoli have to file suit to be heard? Where is the justice when science dominates the spiritual? Where is the justice in one dollar a year rent? Where is the justice when the very entity (the Univ. of Hawaii) responsible for the history of disrespect and injustice is now contracting the management plan? It will take a lot more than the Chamber of Commerce people wearing Malama Mauna Kea t- shirts to convince me there are not hidden concerns for dollar signs on the back side of those shirts.

     Allow me to make another analogy of the conflict of interest of having the University, rather than Kanaka Maoli practitioners, do a CMP for Mauna Kea.
The University's track record of poor management has created the polarization in our community between astronomy and Kanaka Maoli and environmental concerns. It's been said that the University is like the fox in the chicken coup with feathers in its mouth and broken eggs all around. You don't put the fox in charge of the CMP for the hen house. A modern day analogy is this. To put the University in charge of a CMP for Mauna kea is like putting the Wall St. Bankers in charge of a CMP for the financial crisis. These are the guys that created the crisis.

     Obama needs to can his Wall St. cronies and the BLNR needs to pull the plug on the University. If you want a real CMP put Paul Neves, Keala Pischotta, Ku Ching and other Kanaka Maoli practitioners and the Sierra Club in charge.Guaranteed you'll get a genuine CMP.

     Arthur Hoke is concerned about some lolo driving a bull dozer up Mauna Kea. Hello Arthur, where have you been for the past 40 years. The University has been driving bull dozers up Mauna Kea, destroying pu'u, burials, cultural and historic sites and endangered species habitat, etc. to build their telescopes. But it's not just you Arthur. We all should have done more to protect Mauna Kea. Every single one of us.

     In the final anyalsis, I agree with Kihe Soli Niheu. The desecration of Mauna Kea is part of an illegal occupation. It's a symptom. True peace with justice, the process of becoming pono, demands an end to U.S. occupation and the restoration of independent Kingdom of Hawaii.

     Amen.

STOP U.S. WAR FUNDING!

     In Fiscal Year 2009 the U.S. will spend $965 billion for the military (more than the next l5 countries combined). That $965 billion is more than $ll0 million every hour, 24 hours a day, 365 days a year. The so called "War on Terror" including the wars in Iraq and Afghanistan are absorbing $20 million per hour, 24/7/365.

     HOW THESE FIGURES WERE DETERMINED: Current military includes Dept. of Defense ($653 billion), the military portion from other departments ($150 billion), and an additional $162 billion to supplement the Budget’s misleading and vast underestimate of only $38 billion for the “war on terror.” The bottom line is that 54 cents out of every U.S. tax dollar goes to support war (past & present). There will be a Malu 'Aina volunteer farm day this Sat., April 4th, from 9-llAM followed by a pot luck lunch and a vision discussion. April 4th is the 4lst anniversary of the assassination of Martin Luther King Jr.so bring a favorite quote to share of Martin.

Back to Basics:
What are we all about?

     After 7 years of war and occupation in Afghanistan, six years of war and occuapation in Iraq, an increasing loss of civil liberties at home, and now growing economic collapse, no wonder more and more people are feeling fearful and desperate. In such times, it's important to return to core principles of non-violence. In the face of escalating violence, its easy to forget who we are and lose a sense of our own humanity. The winds of war and war and repression can shake the ground upon which we stand, our very foundation, and make us question core beliefs.

     In this our 393rd consecutive week (approaching 8 years) of the Hilo Peace Vigil, each week we've shared a new leaflet but the five points at the bottom remain the same. The main them of all of our leaflets and the core of why we vigil is a deep belief in the principles of non-violence. Non-violence says that the way to peace is through peace, not war. And that peace, to be real and sustaining, must be built on a foundation of justice. Put another way -- the means we use must be in line with the end that we seek, despite the temptation of the "quick fix" of a little "necessary" violence here and a little "necessary" violence there. History shows that violence begets violence, or as Gandhi said, "an eye-for-an-eye now threatens to make the whole world blind."

     So let us be clear, Malu 'Aina rejects war as a solution to anything. We reject violence as a means to an end. We reject the legitimacy of the U.S. empire, any empire, lording it over others, through occupation. The occupations of Iraq, Afghanistan, Palestine and Hawai'i -- all must end. In the struggles for justice and peace we affirm principled non-violent action, as exemplified by the lives of people such as Jesus and Gandhi, and local martyrs in the efforts to Free Hawaii, such as George Helm.

    Principles of non-violent action include: l. Trying to keep our hearts full of aloha at all times; 2. Never killing, injuring or even hating our opponents (hate is too grate a burden to bear); 3. Committing ourselves with perseverance; 4. Staying united in principle and vision for justice and peace; 5. Disobeying orders of authorities that violate our dignity and humanity. 6. Never giving up.

     Martin Luther King Jr. said, "The ultimate weakness of violence is that it is a descending spiral, begetting the very thing that it seeks to destroy. Instead of diminishing evil, it multiplies it. Through violence you may murder the liar but you cannot murder the lie, nor establish the truth. Through violence you murder the hater, but you do not murder the hate... Returning violence for violence multiplies violence, adding deeper darkness to a night already devoid of stars. Darkness cannot drive out darkness, only light can do that."

     None of us are perfect. So as we get weary from years of struggle, disheartened from the slow pace of positive change, or seeing negative change happening in our midst, let us renew our vision for the long haul. No lie can live forever.    Let us help one another to keep our eyes on the prize: committed people-power non-violent action is a power for good that can overcome the greatest evils, and weapons of war, before us.

Peace activist Mike Noe dies

Peace activist, and Malu 'Aina resident for 7 years during the l990s, Lucien "Mike" Noe, died this morning at Hilo Hospital. He was 79. Mike had been under Hospice care for several years with emphysema and recently had surgery for appendicitis.
A memorial service is pending. Mike has asked that his ashes be scattered here at Malu Aina Farm under a Neem tree he planted.
He is survived by 3 children and several grand children. I'll post more details of the memorial as they become available. Please keep Mike and his family in your prayers. Mahalo.

SIX LONG YEARS OF WAR!

     Six years ago yesterday, the Bush administration launched its 'Shock and Awe' assault on Iraq, thus beginning what has turned into one of the longest and most costly military engagements in U.S. history.

     We know what the war and occupation in Iraq has cost: more than one million Iraqis killed; five million Iraqis displaced from their homes; over 4,000 U.S. military troops killed and tens of thousands wounded; more than $600 billion of U.S. tax dollars spent; one of the oldest civilizations on earth brought to ruins. Six long years of a war that never should have happened, an imperial war based on lies and corporate greed. It is enough -- it is too much.

     Today, our hearts are heavy as we remember all who have died and suffered.   Our work is far from over, as the illegal and immoral wars and occupations of both Iraq and Afghanistan continue. Let us not forget the date of the U.S. invasion of Afghanistan -- Oct. 7, 200l. Seven years counting and escalating there. Casualties mount as President Obama shifts troops from Iraq to Afghanistan, and increases attacks deeper into Pakistan.

     Peace activist, Cindy Sheehan, whose son, Casey, died 5 years ago in Iraq says: "It is our shame that we as a nation complacently sit by and allow the audacity of the atrocities of empire to continue in our names. Our demands must be the same with the Obama regime as it was with the Bush regime: Troops home completely and immediately." Not two years from now. Not next year. NOW! NOW! NOW!

     Where is the outrage? Where is the protest? Where are the numbers of people standing up and speaking out against wars and occupations? Some once protested but are now silent. Most have never protested, except talking back to their TV. But justice and peace demands more, that we stand up and speak out publicly. Challenge our fellow citizens to do the same. To the dead, what difference does it matter if the bombs dropped were ordered by a Democratic or Republican U.S. administration? Our silence is our shame.

     Wars and economic collapse are two sides of the same fraudulent coin brought to us by the military/industrial/banking complex. The few get rich at the expenses of the many. Enough!

     It's time to renew our commitment to justice and peace in Hawai'i and throughout the world. It's time to reactivate our activism, or if we have never been an activist, it's time to become one. The future depends on each one of us taking responsibility and joining together in a grassroots peoples' movement. In all of our efforts for justice and peace, remember two important points: l. stay committed to principled non-violence and 2. NEVER, NEVER, NEVER GIVE UP!

Due to finding out today that special permission is needed to gather at the airport intersection, there is a last minute change of location for our peace gathering/sign-holding to mark the 6th anniversary of the invasion of Iraq. Since the airport road location is State Airports Division controlled we will gather on Hwy.11, fronting Borders Hilo. (See flyer below) Please do what you can to pass the word. Lee Bowden and Airport security will be at the airport intersection prior to 4PM to redirect people to the Borders area. Sorry for any inconveniences. May we not be deterred by this last minute change, but rather energized to show up and support this important event.

Hawaii Supreme Court rules against Superferry

By Star-Bulletin staff

The state Supreme Court ruled today that the

state law allowing the Hawaii Superferry to

operate while an environmental impact statement

was conducted is unconstitutional.

The Sierra Club had argued that Act 2, a law

passed by the state Legislature in special

session in October 2007, is unconstitutional

because it was targeted to benefit just one

entity, the Hawaii Superferry. Act 2 allowed the

Superferry to provide Honolulu-to-Kahului service

while the environmental study was done.

A Superferry spokeswoman had no immediate comment

on the court's decision. Sierra Club officials

previously said if the ruling is in their favor

the Superferry would have to cease operations

until the EIS is completed, a process that could

take months.

'Silence is Indefensible'

     "Arundhati Roy, the great Indian writer and activist, has said, "There's nothing new or original left to be said about nuclear weapons." Nonetheless, she speaks out because, in her words, "silence would be indefensible." Silence is the norm. We live our day-to-day lives with these weapons capable of destroying our cities, our countries, our civilizations, even our species. How can silence be the norm?

     "This is what Roy herself says about nuclear weapons, "Whether they're used or not, they violate everything that is humane. They alter the meaning of life itself. Why do we tolerate them? Why do we tolerate the men who use nuclear weapons to blackmail the entire human race?"

    " Do we really trust our political leaders and those leaders who might come to power in the future to never unleash the fury of nuclear war? Do we believe that all leaders under all conditions, no matter how rushed or stressed, will refrain from using this power of annihilation? Perhaps we do, and this would explain the widespread complacency and silence...

     "Are we silent because we believe that nuclear weapons actually keep us safer? This wouldn't be surprising because we have been taught to believe that we are protected by nuclear weapons, but this isn't the case. Nuclear weapons cannot protect their possessors. They can only be used to inflict massive retaliation and such retaliation is not protection. If nuclear weapons protected their possessors, missile defenses would not be needed. But they do not, and missile defenses are faulty tools for protection as well. In fact, those that possess nuclear weapons are guaranteed to be targeted by someone else's nuclear weapons.

     "The only safe number of nuclear weapons is zero, and to reach this level will require international cooperation, like every significant global problem. It will also require leadership and, as the possessors of over 95 percent of the nuclear weapons on the planet, the countries that must lead are the US and Russia. If they fail to lead, the nuclear genie will continue to roam.

     "Why do we waste our resources on such weapons? Why do we use our scientists in such dehumanizing ways? Why do we debase ourselves with our implicit threats of mass murder? Are we silent because we are numb? Have we become so distracted that we will not raise our voices because we cannot imagine consequences so horrific? Have we become so fearful of giving voice to our fears that we are dumb as well as numb?     Nuclear weapons diminish our humanity, and our silence condemns us in the eyes of those who will follow us on this planet. I and others have said all of this before. Like Arundhati Roy, I continue to speak out, often repeating myself, in the belief that silence is indefensible."

Many in Afghanistan Oppose Obama's Troop Buildup

          Mar. 2- Afghanistan Parliamentarian Shukria Barakzai says she has an innovative amendment to Washington's planned injection of up to 30,000 new troops here.   "Send us 30,000 scholars instead. Or 30,000 engineers. But don't send more troops - it will just bring more violence." Ms. Barakzai is among the growing number of Afghans - especially in the Pashtun south - who oppose a troop increase here, posing what could be the biggest challenge to the Obama administration's stabilization strategy. "At least half the country is deeply suspicious of the new troops," says Kabul-based political analyst Waheed Muzjda...

     Much of the Afghan opposition comes from provinces dominated by the Pashtun ethnic group, which include areas that have seen the most fighting and where the new troops will be deployed. A group of 50 mostly Pashtun members of parliament recently formed a working group aimed at blocking the arrival of new troops and pushing for a bilateral military agreement between Kabul and Washington, which currently does not exist...

   "The majority of my people disagree with this increase," says Hanif Shah Hosseini, an MP from Khost province who is not part of the working group. "More troops won't bring more security, just an increase in the fighting..."

   Officials in Washington and Pashtun villagers agree on one thing: They expect the violence to increase this summer as
the new forces attempt to root out insurgent strongholds. "I know once the snows melt, things will start to get much worse," Logar resident Nasar Ahmad says. "The fighting will be intense, and a lot of us villagers are talking about fleeing to Kabul."   "We are worried our families will be caught in the middle," he adds....

WHAT REALLY HAPPENED AT THE U.S. SUPREME COURT

Reading the newspaper accounts of the State of Hawaii v. the Office of Hawaiian Affairs oral arguments at the Supreme Court I asked myself, were they in the same courtroom that I was? Hawaii papers put a phony, positive spin on what actually went down. The stories were written with the kind of provincial slant… home-town-team, win-or-lose, they're-our-boys and we're-darn proud-of- 'em and we-love- 'em.

Well, we do love 'em, but those of us who were there saw a very different picture than the hometown news reported. The fact is, the state and OHA choked.

Hawaii's little league ball teams do much better in rallying and coming through in the clutch in their world-series encounters. But the State and OHA got dirty lickins playing in this big league, world-series- level of court. They performed like a bunch of amateur scam artists, but in nice suits.

In essence, the Supreme Court justices appeared not just skeptical, they seemed to be downright annoyed at the state's convoluted arguments and manipulative efforts to have the federal court undo the results of 14 years of dragging through the state courts.

The justices took their line of questioning way outside the expectations and comfort zone of both the state and OHA. Neither party was prepared to (or wanted to) address the issue of title except to reinforce the state's claim to so-called "perfect title" as "a given." So they did some fancy footwork to try to dodge the title issue; which did not amuse or make any points with the court. Neither was the court pleased when the state and OHA tried to steer the justices back to the actual narrow question on deck about state's rights.

The state's whole case is built upon the premise that the State of Hawaii has "indisputable perfect title" to the "ceded lands." Well guess what? If their title was "indisputable" and "perfect" why are they in court? And why have they been in court over this issue for 14 years? Because there is a dispute! There is a question of title!

The injunction leveled against the State of Hawaii by the State Supreme Court in January 2008 caused the State to run crying to the U.S. Supreme Court saying, "No fair, no fair! The Apology Law would force us to give Hawaiians back the lands stolen from them over 100 years ago! It's ours fair and square because the U.S. gave it to us! The Apology means nothing. We have "perfect title!"

[Ironically, this is the very Apology Law that the state embraces in their support the Akaka Bill. But that's another story.]

The Apology Law undermines the state's "perfect title" claim. The State Court ordered the injunction because the Apology Law clearly shows that there is a dispute -- a big one! The Apology Law flatly says that the seizure of Hawaii was illegal and that the native Hawaiians never gave up their claims (title) to the lands of Hawaii.

These two glaring admissions of fact, framed within this federal Apology Law (USPL 103-150) don't merely suggest a problem of land title; they cast serious doubt on the very legitimacy of the State of Hawaii. How can something that results from an illegal act now be considered legal, or in this case, perfect?

The illegality of the initial act (the seizure of the lands of Hawaii) means that anything else based on that illegal act is likewise, illegal; and that means the State of Hawaii and its construct, OHA are illegal entities. That means the only valid, lawful claimant to the lands and jurisdiction of the Hawaiian Islands is, after all these years, the still-existing Hawaiian Kingdom.

That is why the state claimed right off the bat that it had "indisputable" "perfect title." The state was desperately trying to keep the court from inquiring about any other option regarding title by eliminating that, first off, as a point of contention. But the court's refusal to wear such blinders was unnerving to the state. You could almost hear the state attorney general saying to the court, "focus! focus!"

But just because the state took a beating, doesn't mean OHA fared much better.

Probably the most egregious action that day was by OHA when it chose to agree with the state's "perfect title" position and by doing so, failing to present the Native Hawaiians' un-relinquished claims as a challenge to the state. They virtually abandoned the Native Hawaiian land claim implicit in the Apology Law! By doing so, they virtually abandoned the Native Hawaiians; the clients they purport to represent!

At best it was a stupid legal maneuver; at worst it was a shameful betrayal.

OHA never challenged the state's "perfect title" claim and argued instead that according to state laws, the state had a "fiduciary duty," sort of a moral obligation, to take care of the Native Hawaiians.

That led Justice Ginsburg to ask, "The Native Hawaiians -- they do get 20 percent of the proceeds, correct?" And the OHA attorney to answer, "That's correct…as a matter of State law they get 20 percent of the revenue from the ceded-lands trust…" (we all looked incredulously at each other…since when?) Then he clarified, "…though the amount of that revenue has itself been the subject of protracted and unresolved litigation." Oh, so we get 20%, but not yet! The check's in the mail…

Later, Justice Kennedy stated to the OHA attorney: "Your whole case rests on a cloud on the title in favor of your clients. But you -- you ignore the cloud on the title that has been entered against the State."

So, OHA's strategy is: don't press for the Native Hawaiian's outstanding claim on the land, but instead, shift to begging for handouts from the state because, according to "state law," the state has a "fiduciary duty" to take care of Native Hawaiians. OHA in essence was making a pitch (in the Supreme Court of the United States!) for a welfare claim, not a land claim!

In my opinion, both the state and OHA were way out of their league in this court. But you can't blame them. They had a flimsy case to begin with; one in which they are trying to defend a situation that resulted from a long series of illegal actions. It's very hard to defend a string of lies.

Two good things came from this: 1) the state and OHA have proven they have nothing to stand on, and 2) there is now a gaping doorway for the Hawaiian Kingdom to walk through, assert itself and claim its rightful title the lands of Hawaii.

The Myth of Ceded Lands and the State of Hawai`i's

Claim to Perfect Title

In the recent Ceded lands hearing at the Supreme Court in Washington, D.C., on

February 25, 2009, Attorney General Mark Bennett repeatedly asserted in the hearings

that the State of Hawai`i has perfect title to over one million acres of land that were

transferred to the United States government upon annexation in 1898 and then transferred

to the State of Hawai`i in 1959. This is an incorrect statement. This falsehood, however,

is not based on arguments for or against the highly charged Hawaiian sovereignty

movement; rather, it is a simple question to answer since ownership of land is not a

matter of rhetoric but dependent on a sequence of deeds in a chain of title between the

party granting title and the party receiving title. In fact, the term "perfect title" in real

estate terms means "a title that is free of liens and legal questions as to ownership of the

property. A requirement for the sale of real estate."

What determines a perfect title is a chain of title that doesn't have a missing link. Here in

Hawai`i all titles originate from the Hawaiian Kingdom government whether by Royal

Patents or Land Commission Awards and all subsequent conveyances between

individuals are registered at the Bureau of Conveyances located at the corner of

Punchbowl and Beretania Streets on the ground floor of the Kalanimoku Building. An

example of a chain of title would be the Hawaiian Kingdom government to Joe Smith,

Joe Smith to Alex White, Alex White to Alapa`i, Alapa`i to Yao Wong, Yao Wong to

Jonathan Judd. If there is no record of the deed between Alapa`i and Yao Wong there is a

break in the chain of title and therefore Jonathan Judd cannot claim to have a perfect title,

which is a "requirement for the sale of real estate."

For so-called Ceded Lands, being the Hawaiian Kingdom government and Crown lands,

the chain of title is supposedly from the Hawaiian Kingdom government and Queen

Lili`uokalani to the Provisional government, the Provisional government to the Republic

of Hawai`i, the Republic of Hawai`i to the United States, the United States to the State of

Hawai`i. In this chain, however, there are two missing links and not just one. On January

17, 1893, the Provisional government seized control of the Government and Crown lands

without conveyance, but through revolt, and after investigating the revolt, President

Cleveland reported to the Congress on December 18, 1893 that the Provisional

government was neither de facto (a successful revolution), nor de jure (the lawful

government), but self-proclaimed (committing the crime of high treason). On November

13, 1893, U.S. Ambassador Albert Willis began to negotiate with the Queen, on behalf of

President Cleveland, to grant amnesty for these criminals and an agreement to restore the

Hawaiian Kingdom government was concluded with the condition that the Queen grant

amnesty after the government was restored.

The other missing link is that there is no record of conveyance from the so-called

Republic of Hawai`i to the United States when the Hawaiian Islands were supposedly

annexed in 1898. According to the Merriam-Webster Dictionary, the term cede is "to

yield or give up by treaty." In order for countries to cede territory to the United States it

must be made by treaty, e.g. Louisiana Purchase from France in 1803, or the Alaska

Purchase from Russia in 1867. For Hawai`i, there are two failed treaties of cession, the

first in 1893 and the other in 1897, but the first was permanently withdrawn from the

Senate by Cleveland in March of 1893, and the second was not able to be ratified by the

Senate because of protests by the Queen and Hawaiian subjects. Instead, the United

States enacted a Congressional joint resolution proclaiming that the Hawaiian Islands had

been annexed. The joint resolution of annexation is not a treaty or conveyance from the

so-called Republic of Hawai`i. It is a unilateral declaration that was used to seize and

occupy the Hawaiian Islands during the Spanish-American War. The United States today

could no more annex Iraq by a joint resolution than it could annex the Hawaiian Islands

by joint resolution in 1898. Congressional laws have no effect beyond the borders of the

United States.

If there is no record of a deed from the Hawaiian Kingdom government and the Queen to

the Provisional government transferring Government and Crown lands, there is a break in

the chain of title and therefore the State of Hawai`i cannot claim to have a perfect title,

which is a "requirement for the sale of real estate." As far as the term "Ceded lands,"

there is no such thing because the Government and Crown lands were never "yielded or

given up by treaty" to the United States in the first place. Confusing cession for

occupation is tantamount to confusing adoption for kidnapping. This is not a case of

semantics, but ignorance of the legal and political history of Hawai`i.

Why indictment & prosecution of George Bush, Dick Cheney, Donald Rumsfeld, etc. is a must

A message from Former U.S. Attorney General Ramsey Clark:

     The crimes of the Bush administration must be proclaimed, acknowledged and remembered because their disastrous human consequences, dictatorial tendencies, subversion of Constitutional government and violation of the rights and dignity of humanity. They include wars of aggression, the crime against peace and the "Supreme International Crime," war crimes, and crimes against humanity, genocide by military violence "with intent to destroy in whole, or in part, a national... or religious group," authorizing and condoning massive violations of the Constitution of the United States, its Bill of Rights and other Amendments, international treaties including the U.N. Charter, Treaty on Non-Proliferation of Nuclear Weapons, Convention Against Torture, International Covenant on Civil and Political Rights, and the Geneva Conventions.

     The indictment of George W. Bush and other high officials is the challenge facing 'We, the People.' Will we rise to meet it? This is not a matter of politics or partisanship. It is the defense of the basic tenets of the Constitution...

     The greatest danger arising from impunity for President Bush and his cohorts would be that all subsequent officials will feel secure in committing the same crimes and the people, having failed to compel impeachment for such open, notorious and egregious crimes, will feel even more helpless to prevent them. Ultimately the power and the responsibility to prevent criminal acts by government is with the people.

     The movement for accountability is sweeping the country. The Chair of the House Judiciary Committee, John Conyers, and the Chair of the Senate Judiciary Committee, Patrick Leahy, are both proposing to launch investigations into the possibilities of criminal conduct by high officials in the Bush Administration. Our sacred summits -- Mauna Kea and Haleakala -- are protected by law as conservation districts. These are public trust ceded lands--Hawaiian lands--held by the state in trust for the people of Hawaii. Yet, today Mauna Kea's public lands are exploited by foreign corporations and the University, who are profiting from telescope activities on the summit at the public's expense.
"The rent from the foreign telescope-owners is 30 years past due--they have paid only $1 a year to misuse Mauna Kea. If the state had been collecting the $50 million dollars a year from these foreign telescope-owners, like we suggested to them years ago, we would not have these budget shortfalls now. Remember, $50 million in 1 year is $100 million in just 2 years. They owe the people of Hawaii for 30 years of back rent. How dare they suggest to short-change the taxpayers now." --Kealoha Pisciotta, President Mauna Kea Anaina Hou.
Forty years of uncontrolled telescope construction has desecrated cultural sites, contaminated the ground above the primary aquifer, and destroyed 90% of the endemic Wekiu's habitat. Today, developers are vying to build two new telescopes (along with roads, parking lots, office buildings, and gift shops) on undeveloped habitat around the summit area. One of them -- owned by the California Thirty Meter Telescope Corporation -- is larger than all the current telescopes combined and will bulldoze the last pristine peak near the summit.
The only thing stopping them is the law. That is why the University is working hard to overturn the laws that currently protect our sacred summits and limit telescope construction. Two courts of law and two state audits have already found that the telescope industry violated the state and federal laws meant to protect Mauna Kea. The only way their future telescope construction plans can go forward is for the University and the telescope developers to change and exempt themselves from these protective environmental laws.
This latest bid to take over Mauna Kea has two fronts:
1. Pressure the Land Board to adopt an illegitimate management plan that limits public access, dictates religious ceremony, and allows UH and telescope developers to pocket public money,
2. Lobby the Legislature to pass one of four bills that will hand-over authority for managing Mauna Kea to the primary developer of the summit, the University of Hawaii.

All of it comes down to the University's same, long-sought goal: make it easier to exploit Mauna Kea for money. The latest proposal on the table would allow the University to restrict public access (including how and when Hawaiians may worship at the sacred summit), pocket all the money made on Mauna Kea, and exempt themselves from public oversight. This is a public policy and legal nightmare!
"The University wants to gate the road to Mauna Kea--the road was paid for by taxpayers, it's a public road. The University wants to require Hawaiians to get a permit to worship--Mauna Kea belongs to Ke Akua, they cannot lock the people out of the temple. Even if Hawaiians could get a permit, it would mean they couldn't bring their non-Hawaiian friends and ohana to ceremony. This is discrimination! The Economic Cost
of the Military Industrial Complex!

      These are the words of Republican President Dwight D. Eisenhower, the Supreme Allied Commander during World War II, in his farewell address to the nation in l96l.

     The United States... currently spends more on military than the next 45 highest spending countries in the world combined. The U.S. accounts for 48% of the world’s total military spending.... According to the Defense Department’s latest "Personnel Strengths" report, the United States now has troops stationed in 147 countries and 10 territories...

     President Eisenhower’s final words are the most chilling. "In the councils of government, we must guard against the acquisition of unwarranted influence, whether sought or unsought, by the military industrial complex. The potential for the disastrous rise of misplaced power exists and will persist."

     War and non-stop conflict benefit the military industrial complex... It appears that the biggest winners of the War on Terror are the CEOs of the war contractors... If as a country we continue to allow our politicians and their military industrial complex corporate sponsors to spend $700+ billion per year on weapons, to the detriment of higher education, alternative energy projects, and national infrastructure needs, we will be paying an extremely high price...

CANCEL THE MILITARY'S
LAND LEASE AT POHAKULOA

     It's been over 7 months since the Hawaii County Council passed an historic resolution July 2, 2008 calling for a halt to all live-fire, B-2 bombing missions, etc. at Pohakuloa (PTA) until there is an assessment and clean up of the radiation contamination already present. But the live-fire continues at PTA with Army Hawaii Garrison Commander, Col. Steve Mercardo, saying insultingly on Nov. ll, 2008 that the Council's action "is only a resolution," and that stopping live-fire at PTA "is not going to happen." This tells us that our community health and safety is secondary to military training. So who and what is the military supposedly defending?

     On Feb. 3, 2009 Col. Howard Killian told the Hawaii County Council that the number of radiation Davy Crockett spotting rounds fired at Pohakuloa may be much higher than originally thought, now possibly over 2000. But the Army is clearly not looking for the possibly far more dangerous uranium oxide contamination from modern DU penetrating rounds that may have been fired at PTA and other Hawaii rangers. Less than l% of PTA has been surveyed and that just for the Davy Crockett spotting rounds. If you are not looking outside the Davy Crockett ranges, you are not likely to find other DU weapons evidence. The military is stonewalling on seriously investigating all radiation contamination at Pohakuloa and it has no intent of stopping live-fire which threatens to spread the radiation mess.

     Back in the l960s around the time the Army was firing Davy Crockett DU spotting rounds at PTA, the Army got a State lease for land in the Waiakea Forest reserve, Hilo's watershed. The Army told the State it wanted to do "weather" testing. The Army was lying. The Army was testing deadly nerve gas agents, one of them so toxic that l/50th of a drop would kill you. The late U.S. Representative Patsy T. Mink helped disclose the secret nerve gas testing. People stood up to protest. The cry was: cancel the military lease. Even the Mayor joined in the chorus and the State canceled the military lease in the Waiakea forest. Today the military is leasing land at PTA. Of the l33,000-total acres at PTA, 24,000-acres were recently purchased from Parker Ranch. For the remaining l09,000-acres the Army is paying the State a grand total of ONE DOLLAR for 65 years. These are occupied Hawai'i Kingdom lands, Hawaiian Home Lands. Perhaps it's long past time to again raise the cry: CANCEL THE LEASE.

Military radiation contamination in the U.S. widespread from U.S. Depleted Uranium weapons training

Army Col. Howard Killian of Ft. Shafter Hawaii gave a power point presentation on Feb. 3rd to the Hawaii County Council on radiation contamination at Pohakuloa Training Area (PTA) in the center of Hawaii Island. On page six of his power point hand out he list ll states and 3 foreign countries where the U.S. shipped 75,3l8 depleted uranium MOl0l spotting rounds to be fired in training.
The states include: Maryland, Georgia, Kentucky, Texas, Washington, Kansas, Hawaii, Pennsylvania, Missouri, Colorado, , and California. Foreign countries include Japan (Okinawa), Germany and South Korea.

The number of MOl0l spotting rounds the military originally said that were shipped to Hawaii was 7l4. But on Feb. 3rd. Col. Killian said the types of exercises conducted at the Pohakuloa Training Area (PTA) would require the firing of at least 2,050 such spotting rounds.(West Hawaii Today, Feb. 4, 2009)

Dr. Lorrin Pang, MD, MPH, retired 20 yr. Army Medical Corps and listed among America's best doctors, said there is reason for concern.

"What COL Killian allegedly says does not really address the issues that the civilians repeatedly brought up. Besides spotting round civilians worried that penetrators might be used. Penetrators release much greater amounts and wider variety of chemicals such as DUOxides (DUO) which are more dangerous due to slow clearance from the body (compared to DU), insolubility, route of inhalation and distribution through the body via the macrophage lymph system. The evidence for this penetrator use might be to find DU levels (or DUO) above that predicted by the reported number of spotting rounds, though that number keeps changing. If penetrators were used and discontinued - what is left on the ground may be of no imminent or future risk to health/contamination - just as ashes from a cigarette in and of themselves are not dangerous. But they are a marker that someone smoked and in the case of the civilians, second hand smoke, a health risk. In light of the Gulf War Syndrome (GWS) being real and the uncertainty as to its cause I think no one can set a health threshold for DUO inhalation. Or penetrator DU use. Whether or not spotting rounds convert to dangerous DUO forms with subsequent bombardment of the target zones, that is something that air monitoring is trying to detect. There will be an important volunteer farm day (rain or shine) this Sat., Feb. 7th from 9-ll:30 with a pot luck at noon. From ll:30-l2 we'll take a walk-through the adjacent land that we are seeking to acquire for help with growing food for people in need.
After our noon pot luck we'll have a one hour vision meeting on the new land and update on the land acquisition process
I'm here living on the farm myself these days. There were a couple of last minuted cancellations by expected volunteers. We have been extra busy recently with peace activities, and requests for help by people in need of food keeps increasing. All of these things take time away from what needs to be done on the farm day-to-day, so your volunteer help is especially needed with weeding the taro patches. Military Stonewalling on Radiation Contamination

     As expected, Army Col. Howard Killian of Ft. Shafter, Oahu, gave a slick Power Point presentation to the Hawaii County Council to give the appearance the military is exercising due diligence over the issue of military radiation contamination on Hawaii Island. As one citizen testified, Col. Killian's appearance reminded him of Collin Powell's testimony at the UN leading up to the start of the Gulf war. It was all shibai.

     It has not exactly been "four-score and seven years ago," but it has been seven months and one day to be exact, that the Hawaii County Council passed an historic resolution July 2, 2008 by a vote of 8-l with the only dissenting vote being retired Army Intelligence Col. Pete Hoffmann. That resolution called for the following:

     l. Order a complete halt to B-2 bombing missions and to all live firing exercises and other activities at the Pohakuloa Training Area that create dust until there is an assessment and clean up of the depleted uranium already present;
     2. Establish a permanent, high-tech monitoring system with procedures to ensure air quality control;
     3. Establish a citizen monitoring system to work closely with Military experts to assure transparency and community confidence;
     4. Host quarterly meetings to update and inform the public;
     5. Ensure permanent funds are available for the monitoring program;
     6. Provide a liaison to the County of Hawaii to facilitate communication between the U.S. Military and the County of Hawaii;
     7. Provide semi-annual reports to the Hawaii County Council summarizing depleted uranium monitoring, detection, and mitigation efforts; and
     8. The U.S. Military shall conduct a search of all records for firing of Depleted Uranium at the Pohakuloa training Area and all other Hawaii State military sites and release pertinent information to the public...

     In addition to the above resolution the Council also passed an additional resolution naming Hawaii born, Dr. Lorrin Pang, MD, MPH, retired Army Medical Corps, and among "Who's Who of America's best doctors, as the county's representative to a citizen's monitoring committee (see point 3 above) to work with the military on the DU issue. The military rejected Dr. Pang and has yet to form a citizen's committee on the DU issue. Cory Harden of the Sierra Club was named to a military Citizens Advisory Council, but when she tried to raise concerns on DU she was basically told this was not part of the council's work. That Citizens council appears to be more a PR tool for the military to go out to schools, etc.to shine its image.

     To date the military has done virtually nothing to meet any of the above eight points called for in the July 2008 County Reso. Bombing and other live-fire continues, no permanent high tech monitoring has been set up that citizens can access from their home computers, no citizen monitoring committe has been established, no public meetings have been held, no thorough search of records have been made, etc. Col. Killian's appearance, at the request of Council member Hoffmann, before the Council was to provide an update on the issue. The West Hawaii Today noted in a news article on l/3l/09 announcing Col. Killian's Council visit that "the military recently completed tests to determine whether any of the material poses a threat to army personnel at PTA or residents. Although the tests won't be made public until spring, military officials recently reported the tests determined no danger exists."

     At the Council meeting, several citizens from Hilo and Kona testified against the military's phony claims of "No Danger." They said "SHOW US THE DATA." Col. Killian offered no data to validate his claims of "NO DANGER." In fact what he revealed exposed the fact that the military is NOT looking for anying but the old Davy Crockett DU spotting rounds fired in the l960s. What was first said to be possibly 7l4 such rounds now maybe 2050 according to Col. Killian, most, if not all, pulverized to bits, and spread with the wind, by decades of live-fire on top of them.They only found one relatively intact, and pieces of 2 others. But the Army is clearly not looking for the possibly far more dangerous uranium oxide contamination from modern DU penetrating rounds that may have been fired at Hawaii ranges. Killian revealed only 40 of the l34,000-acres of PTA have been ground surveyed for DU Davy Crockett spotting rounds by the Army. 900 total acres (less than l% of PTA) have been surveyed by air for the Davy Crockett which is not a very effective way of trying to confirm the presence of short alpha particles with equipment. It's like a self-fulling prophecy. If you are not looking outside the Davy Crockett ranges, you are not likely to find other DU weapons evidence.

     Now the military is going to contract for air sampling and the places Killian showed for military monitor locations are in my judgment the least likely areas to pick up evidence of uranium oxide particles blowing in the wind. The monitoring sites are all on the north (Mauna Kea) side of the PTA impact range when the predominant winds would blow east to west, and in the afternoons/evenings often west to east. And it's not even clear if the air monitors are designed to detect uranium oxide particles.

     The most interesting part of the day with Col. Killian occurred after his council presentation, which by the way was picketed by l0 people outside the Council building with signs that said: "Stop the Bombing," "Radiation Cover Up," "Are we breathing radiation?" "Protect the aina" etc. I received word that Col. Killian was holding a press conference at the Hilo Hawaii Hotel at lPM, so together with 2 other friends we decided to attend. As a blogger I am a member of the media. But when I got to the hotel I was told by Army Public Affairs Officer from Oahu, Howard Sugai, that I was not invited and that if I stayed he was going to cancel the press conference. I told him that I wrote for a blog on our website (malu-aina-org see current news) and that if there was really "NO DANGER" as the military claimed then why the fear, why the stonewalling, why no community involvement, no transparency, etc. Could it be the military has something to hide." Shortly 2 other news people showed up, including Bret Yeager of the Hawaii Tribune-Herald and were told the news conference was canceled. Other news people arrived. Rod Thompson of the Honolulu Star-Bulletin ripped into Howard Sugai saying "Pohakuloa is stonewalling the media." Thompson went on to describe a PTA tour offered the media that only included military barracks and a hill at the main base camp. The media was denied to go to firing points, etc. Then Col. Killian arrived and the "cancelled" press conference was suddenly on again. Sugai had his local PR assistant call 2 of the media people who left to tell them to come back.

     Col. Killian stressed that uranium levels detected are well below EPA threshold levels and therefore "NO DANGER" even though air sampling studies have yet to be done. It needs to be pointed out that as Dr. Lorrin Pang emphasizes, uranium oxide particles constitute a very different hazard and the health effects of Uranium oxide inhalation need a lot more study. Just like for years the Army tried to deny any Gulf War Syndrome but now it is acknolwedged as real and to be affecting 300,000 or more Gulf war vets. The same with Agent orange from Vietnam. Uranium oxide particles may be the military nightmare of the 2lst century. The problem with DU is it has a half-life of 4.5 billion years so it will be around for a long, long time. The Army's Health Physicist, Mark Mellanson, from Walter Reed Hospital, brought to Hawaii Nov. l8, 2007 to speak at a Waimea meeting on DU told the audience that Gulf War Syndrome was just stress like after any war. Well, he has been proved wrong on that so his credibility on DU is not very high either. He reminded me of a bought and paid for tobaco company spokesperson in the l950s telling people there is no conclusive evidence linking smoking to lung cancer.

     Killian said Dr. Jim Morrow, a private consultant, who did dust monitoring for the Stryker EIS in the Keamoku area has been contracted by the Army to do the l year air monitoring study starting Feb. 9, 2009 at PTA.
What's clear is the military already has no plans to try and clean up any DU at PTA, except where it might be found where the military intends to build new buildings. The Nuclear Regulatory Commission (NRC) is coming to Oahu in March, but has no intention of even visiting Pohakuloa. The plan is simply to continue "Business As Usual" at PTA.
So much for protecting the citizens of Hawaii Island. It seems, instead of needing protection form "terrorist enemies" abroad, we need protection from the U.S. military contaminating us with radiation, claiming to be defending "freedom & democracy."

MILITARY RADIATION STONEWALLING

Army Col Howard Killian will do an update on the Pohakuloa radiation for a County Council committee 10:30 AM Tue Feb 3rd at the Ben Franklin bldg. in Hilo.

     Malu 'Aina charges the military is stonewalling and misinforming the community over the issue of radiation contamination at the l33,000-acre Pohakuloa training Area (PTA). The military continues to make unsupported claims that radiation contamination at PTA poses "NO DANGER" to troops or residents (WHT l/3l/09).

     Malu 'Aina says to the military: SHOW US YOUR DATA. Danger or No Danger is a medical determination that is debatable. First get an accurate determination of the extent of radiation contamination. Where is the data, and how was it obtained? What testing has been done to detect levels of contamination? How widespread is the contamination? Have DU penetrating rounds been fired at PTA? It appears that the military only wants to focus on l960s era DU Davy Crockett spotting rounds fired and ignore the possibility that a wide range of modern day weapons that contain radiation have also been fired at PTA and other sites in Hawai'i.

     The military has a serious credibility problem. The military has consistently stonewalled community involvement in the investigation process which the community demanded to assure transparency and the confidence of the community. The military's credibility problem is longstanding. The military lied to the community when it secretly tested deadly nerve gas weapons in the Hilo Waiakea Forest watershed around the same time it was firing DU Davy Crockett spotting rounds at PTA. For years the military tried to downplay or deny health problems associated with Agent orange used in Vietnam. The military tried to deny Gulf War Syndrome (GWS) but now it's been found to be real and effecting 300,000 troops. Here in Hawaii, Federal Court Judge Susan Mollway has ordered the military to stop stonewalling on cultural access at Makua Valley on Oahu.

      If the military is so convinced there is "NO Danger" from radiation at PTA, then why the stonewalling? Why no community involvement, no data, no transparency? Could it be they know they have something to hide?

      Malu 'Aina calls for the County Council to provide Dr. Lorrin Pang equal time for a presentation to the Council regarding this issue. Mahalo.

POHAKULOA HEALING CEREMONY AND PROTEST

Aloha Kakou,

     Approximately 50 Big Island residents gathered on Saturday, Jan. 3lst from l0AM till lPM at Mauna Kea Park, adjacent to the l33,000-acre military Pohakuloa Training Area (PTA). Troops were present at PTA but no live-fire was observed. The purpose of the gathering was twofold. First to conduct a healing ceremony for the 'aina and second, to protest the ongoing military bombing, radiation contamination, desecration and occupation of the Hawai'i Kingdom. People brought ho'okupu (offerings) for the healing ceremony. Ali'i ai Moku, Paul Neves, of the Royal order of Kamehameha, brought his Halau who offered ole and hula as part of the ceremony. Kaliko Kanaele, a member of the Royal order and a long-time activist taught chants to those gathered about the importance of pulling together and bringing things to light. A number of people shared personal stories and thoughts on resistance. Protest signs at the gathering read: "Aloha 'Aina --A Call to Action," "Stop the Bombing," "End U.S. Occupation," "Make Peace--Work for Justice." "The Kingdom Lives - Return Ceded Lands." Throughout the gathering there was obvious military/police surveillance from vehicles in the park and adjacent military areas.

     Throughout the ceremony and protest strong trade winds were blowing from Hilo so our gathering was fortunately upwind of the PTA base impact area. No above background readings were noted on several radiation monitors present unlike May 29, 2007 when winds were blowing directly off the PTA impact area toward Mauna Kea Park and citizen monitors recorded several spikes 4 times background levels.

     People who came from Kona noted there was an American flag waving pro-war group of about 20 people at the PTA main gate area, located about l mile from Mauna Kea Park. Among those present was Andrew Walden, editor of the right wing now defunct Hawaii Free Press newspaper.

     Following the healing ceremony, speakers, and a pani of shared food at Mauna Kea Park, several people carried the protest to the PTA main gate area. Protest signs were set up directly in front of the PTA main gate, across Saddle Road from the Pro-war demonstration. Ho'okupu from the healing ceremony were left on the triangle piece of land fronting the PTA main gate. Some exchange of thoughts took place across Saddle Rd, but all went peacefully.

     The West Hawaii Today, Jan. 3lst newspaper ran an article saying that Army Col. Howard Killian will be giving a presentation to the Hawaii County Council Intergovernmental Relations Committee at l0:30AM on Tuesday, Feb. 3rd. on depleted uranium at the Pohakuloa Training Area. The article said, "the military recently completed tests to determine whether any of the material poses a threat to army personnel at PTA or residents. Although the tests won't be made public until spring, military officials recently reported the tests determined no danger exists."

     This kind of statement about "no danger exists" is a military medical judgment. The military keeps repeating "no danger" with no data available for examination. We demand data on the radiation contamination, control data, etc. We want to know the extent of the radiation contamination and if DU penetrators have been used at PTA which we highly suspect. The military is trying to focus ONLY on DU Davy Crockett spotting rounds from the l960s. The military has a proven track record that it cannot be trusted to tell the truth.

Dear Peace Ohana,

For all those planning on coming to the spiritual ceremony for healing the aina and peaceful protest at Pohakuloa, please note the following:

l. We will be meeting at l0AM at Mauna Kea park -- l mile Hilo side of the Pohakuloa (PTA) main gate. Car pools will leave Hilo Bayfron at 9AM after sign holding from 8-9AM at the intersection of Pauahi and Kamehameha Ave. Those coming from Kona side please be on the lookout for military training and note mile marker of the training as you drive Saddle Rd. to Mauna Kea Park.
2, Please come in a spirit of non-violence. It is possible we will encounter military troops that are training there. Be respectful of all people, even those who oppose us.
3 Come prepared for all weather. Bring warm clothes, rain gear, sun screen, hat, water, walking shoes, and a snack to share if possible.
4. Bring a ho'okupu (an offering --as simple as a ti-leaf -- if you wish) for the ceremony. Paul Neves will be coming with members of his Hula Halau for the ceremony of healing for the aina. I will bring extra ti-leaves and some fruit and cooked taro and sweet potatoes for sharing at Mauna Kea Park after the ceremony and peaceful protest. As for the protest, we may choose to go to the PTA main gate area or a site adjacent to training along Saddle Road. In all that we do, let us walk in the spirit of peace.

Justice & Peace Makers Unite! On Saturday, January 3l, 2009 there will be a spiritual ceremony of healing for the 'aina and peaceful protest of the U.S. military bombing, contamination, desecration of the aina at the l33,000-acre military Pohakuloa Training Area (PTA) in the center of Hawaii Island. PTA and the military's disregard of community concerns are symbols of the continuing U.S. occupation of the Hawai'i Kingdom. Justice demands an end to this occupation.

Background

The Francis Newland Resolution of 1898 is the basis for the U.S. piracy of Crown and Government lands of Hawai'i to the U.S. by the pirate “Republic of Hawai‘i". However, the U.S. refused to recognize the so-called “Republic of Hawai'i” following the U.S. invasion of the Hawai'i Kingdom in 1893; attempted treaties of annexation failed; and neither U.S. nor international law allows annexation of a Kingdom to a Republic.

The Hawaii County Council passed resolution, 639-08, on July 2, 2008 over radiation contamination at Pohakuloa. The resolution calls for 8 protective measures, including a halt to live-fire, a full assessment and cleanup of the DU present at Pohakuloa, citizen monitoring system, public meetings, reports, etc. To date the military has not responded positively to any of the 8 points called for by the Hawaii County Council. The military is stonewalling. The military is endangering its own troops and the people of Hawai'i by refusing to halt live-fire and clean-up its harmful and long-lasting radiation contamination.

Below is a statement to try and help frame the issue of Pohakuloa in the broader context of an occupied Hawaii.

A Call to Action!

     This is a call to action to the people of Moku O Keawe (Hawai'i Island) to join in a protest and spiritual ceremony of healing for the 'aina at Pohakuloa on Saturday, January 3l, 2009 at l0am. We are protesting the unprovoked invasion and continuing occupation of the Hawai'i Kingdom by the United States. The military is desecrating our aquifer and sacred mountains, and spreading radiation contamination at the l33,000-acre Pohakuloa Training Area (PTA) in the center of our island home.

    The Hawaii County Council passed resolution, 639-08, on July 2, 2008 following extensive public testimony in reaction to health risks from military radioactive and chemically toxic Depleted Uranium (DU) radiation. The resolution calls for 8 protective measures, including a halt to live-fire, a full assessment and cleanup of the DU present at Pohakuloa, citizen monitoring system, public meetings, reports, etc. To date the military has not responded positively to any of the 8 points called for by the Hawaii County Council. The continued stonewalling by the military over the issue of radiation contamination on our island completely ignores the community health and safety that the military is charged to protect and is disrespectful of the leaders and people of our island. Military statements that the Hawaii County Council's call to action is "only a resolution" and that halting live-fire at PTA is "not going to happen" tell us that community health and safety are secondary to military training and lead us to question who and what the military is defending.

    Hawai'i-based military forces have through executive order userped 200,000 acres of land; 60,000 square miles of special use airspace; and 200,000 square miles of Hawaiian waters. The military has been a bad steward of land and sea -- it has desecrated and contaminated hundreds of sites with unexploded ordnance and other hazards, devastated large areas with wildfires, and dumped radioactive waste and thousands of tons of chemical munitions and unexploded ordnance in our oceans. Now the military further endangers the people of Hawai'i by refusing to clean up its harmful and long-lasting radiation contamination.

Calls for Prosecuting Bush and Cheney

     The U.S. Veterans For Peace (VFP) 2008 national convention passed a resolution calling for prosecuting George W. Bush, Dick Cheney and other Bush administration officials for war crimes, crimes against peace, and crimes against humanity.

     The Vets said the 2003 invasion of Iraq was not only immoral but illegal, violating numerous U.S. and international laws, including but not limited to USC 244l (War Crimes Act of l996), the Geneva Conventions, the Nuremberg Tribunal Charter, the U.N. Charter, and the Laws and Customs of War on Land. The Vets organization lists six pages of violations of the above laws and says it is still but a partial listing.

     The Vets charge the U.S. Congress for spineless dereliction of duty for failing to take action against Bush and his administration while Bush was still in office. The organization quotes former U.S. Supreme Court Justice, Robert Jackson, who was appointed by President Harry Truman to be the Chief Prosecutor at the Nuremberg Tribunals following World War II. Jackson stated prophetically, "...let me make clear that while this law is first applied against German aggressors, the law includes, and if it is to serve a useful purpose it must condemn aggression by any other nations, including those which sit here now in judgment."

     The VFP organization says that "as citizens of the United States we are complicit in the crimes of the Bush administration in Iraq because we cannot claim ignorance of these criimes." The organization concludes by saying "for the sake of humanity, for the sake of history, and to absolve even a small measure of the complicity we each share as U.S. citizens, we must do everything in our power to hold our leaders accountable and bring them to justice. As Veterans For Peace, we "will take every appropriate measure on our own and in coalition with others to insure that George W. Bush, Dick Cheney, and responsible members of their administration are prosecuted for war crimes, crimes against peace and crimes against humanity before any court claiming jurisdiction in the U.S. or abroad, for as long as they shall live."

   Gandhi once said "An eye for an eye will make the whole world blind." It now seems "an eye for an eye" really means 100 eyes for one eye -- heading

     Time is of the essence. A surge in international pressure can stop the Israel/Palestine violence. The faster the pressure surges, the sooner the violence will stop, and the more lives will be saved. There is little reason to doubt that U.S. pressure for an immediate cease-fire would have an impact. If President-elect Obama and Members of Congress would speak up now, it would add decisively to international pressure to end the violence.

      For six months there was a cease-fire between Israel and Hamas that resulted from indirect talks between Israel and Hamas that were brokered by Egypt and actively encouraged by the United States. The main sticking point in renewing the cease-fire was the failure to ease the economic blockade of Gaza, which former President Carter has called an "abomination."

     There is every reason to believe that even a small shift in U.S. policy could have dramatic effects. The present Israeli policy was developed in close coordination with the Bush Administration. President-elect Obama has pledged to reach out to the Muslim world and put a new emphasis on diplomacy. Few changes would have more dramatic impact than ending the policy of isolating Gaza and trying to crush Hamas, which has brought humanitarian catastrophe.

     Caution: Be on guard for possibly Israel and/or Bush/Cheney creating a pretext to attack Iran before Bush leaves office, in effect handing President-elect Obama WWIII in the making.

This truth about suicides was brought to the public in a class action lawsuit by Veterans for Common Sense and Veterans United for Truth on behalf of 1.7 million Americans who have served in Iraq and Afghanistan. The two groups allege the Department of Veterans Affairs has systematically denied mental health care and disability benefits to veterans returning from war zones.

A Call to Action!

     This is a call to action to the people of Moku O Keawe (Hawai'i Island) to join in a protest and spiritual ceremony of healing for the 'aina at Pohakuloa on Saturday, January 3l, 2009 at l0am. We are protesting the ongoing illegal occupation of the Kingdom of Hawai'i by the United States, the military's desecration of our sacred mountains, and radiation contamination at the l33,000-acre Pohakuloa Training Area (PTA) in the center of our island home.

     The Newlands Congressional Resolution of 1898 is the basis for the U.S. illegal occupation of Hawai'i. It claims to accept the ceding of the Kingdom of Hawai’i to the U.S. by the illegitimate “Republic of Hawai‘i". However, the U.S. refused to recognize the so-called “Republic of Hawai'i” following the overthrow of the Hawaiian monarchy in 1893; two attempted treaties of annexation failed; and neither U.S. nor international law allows annexation of a sovereign country without a lawful treaty.

    The Hawaii County Council passed resolution, 639-08, on July 2, 2008 following extensive public testimony in reaction to health risks from military radioactive and chemically toxic Depleted Uranium (DU) radiation. The resolution calls for 8 protective measures, including a halt to live-fire, a full assessment and cleanup of the DU present at Pohakuloa, citizen monitoring system, public meetings, reports, etc. To date the military has not responded positively to any of the 8 points called for by the Hawaii County Council. The continued stonewalling by the military over the issue of radiation contamination on our island completely ignores the community health and safety that the military is charged to protect and is disrespectful of the leaders and citizens of our island. Military statements that the Hawaii County Council's call to action is "only a resolution" and that halting live-fire at PTA is "not going to happen" tell us that community health and safety are secondary to military training and lead us to question who and what the military is defending.

    Hawai'i-based military forces have taken control of 200,000 acres of land; 60,000 square miles of special use airspace; and 200,000 square miles of ocean operating areas. The military has been a bad steward of land and sea -- it has desecrated and contaminated hundreds of sites with unexploded ordnance and other hazards, devastated large areas with wildfires, and dumped radioactive waste and thousands of tons of chemical munitions and unexploded ordnance in our oceans. Now the military further endangers the people of Hawai'i by refusing to clean up its harmful and long-lasting radiation contamination.

     Please join us in a spiritual ceremony of healing for the 'aina and peaceful protest of the U.S. military bombing, contamination, desecration and occupation of the independent nation of Hawaii.   Meet l0 AM Saturday, January 3l, 2009 at Mauna Kea Park - located l mile Hilo side of PTA's main gate. Mahalo nui loa.

Wanted: A Climate Bailout
by Mark Hertsgaard

What a difference an emergency makes. Scare people enough and $700
billion can materialize almost overnight. The White House can repudiate
its core economic philosophy--government should leave markets
alone--within hours. Congress, where spending bills sometimes wait years
to reach the floor, can pass one of the costliest laws in its history
within days. Even the endlessly fickle media can provide 24/7 news
coverage, making the emergency the topic on everyone's mind.

When will we see this same sense of urgency devoted to the greatest
emergency of our time? You wouldn't know it from our politicians or TV
shows, but the climate crisis is even more serious than the financial
crisis. The financial crisis, while painful and severe, can be resolved,
given time and wise policies. The climate crisis, not so. The earth's
climate system has tipping points beyond which no return is possible.
Yet there is a very real danger right now that sliding oil prices will
lull the public into an even deeper complacency.

The system passed the first major tipping point twenty years ago, when,
according to 1988 Congressional testimony from James Hansen, the chief
climate scientist at NASA, man-made global warming began. A second
tipping point was passed a few years ago, when global warming began
triggering climate change: abnormal droughts, storms and other extreme
weather. The problem is, once climate change begins, it cannot simply be
turned off. The inertia of the climate system ensures that even if every
country in the world went green as quickly as possible, the earth would
still be locked into fifty more years of rising temperatures and the
impacts they unleash. Thus, by 2050 European summer temperatures will
routinely reach the record highs experienced in 2003, when an estimated
70,000 people died. The snowpacks atop many of the world's mountains--a
source of drinking and irrigation water for more than a billion
people--will have melted and shrunk. Sea levels will be rising
significantly.

We are now in danger of passing a third tipping point--the descent into
cataclysmic, irreversible climate change. Hansen returned to Capitol
Hill in June, on the twentieth anniversary of his 1988 testimony, to
warn that the earth is on the verge of "disastrous climate changes that
spiral dynamically out of humanity's control," causing "mass extinction,
ecosystem collapse and dramatic sea level rises." To avert this
catastrophe, Hansen continued, "is, barely, still possible. It requires
a transformative change of direction in Washington in the next
year"--that is, by the end of 2009, when the world's governments will
meet in Copenhagen to negotiate new reductions in the greenhouse gas
emissions that cause global warming.

Every candidate running for election, and every journalist covering
them, should be required to spend the twenty minutes it takes to read
Hansen's latest testimony, because they obviously still don't get it. We
face a code-red emergency. At stake is the survival of human
civilization. Yet the candidates and media treat global warming as just
another issue. Even Barack Obama, who takes the problem seriously, seems
not to grasp the urgency of the moment. (The same is true in Europe,
where governments have invoked the economic downturn as grounds for
delaying emissions cuts.)

The United States and the world need to launch a climate rescue plan
that is at least as ambitious as the financial rescue plan. We need a
massive shift of government incentives and funds away from fossil fuels
and toward energy efficiency, solar and wind power, and other low-carbon
alternatives. We must also end rampant deforestation, which causes 20
percent of global greenhouse gas emissions while imposing enormous
economic costs. (A new study by the European Union found that
deforestation costs far more every year than the financial crisis,
because when forests disappear humans must pay for ecosystem
services--storage of water, neutralization of carbon dioxide--that
previously were free.)

The good news is that a massive green jobs and investment program is
economically appealing and politically plausible. The program would pay
for itself over time by generating additional income, profits,
innovation and market opportunities, which doubtless accounts for the
support it has gained from such mainstream sources as New York
Times columnist Thomas Friedman, not to mention the Democratic
presidential nominee. A green jobs and investment program is the core of
Obama's proposed energy policy as president, but he is still thinking
too small: he proposes spending $15 billion a year for the next ten
years, when the crisis calls for spending much more, much faster.

Friends of the Earth was the first environmental group to oppose the
$700 billion bailout, warning that it would put the next president "in a
fiscal straitjacket." But a straitjacketed Obama should still spend big
to go green, says Friends of the Earth president Brent Blackwelder.
"There is enormous public support for it, and it's what the climate
requires." It's also what the economy requires: with a
recession/depression threatening the global economy, deficit spending is
the least of our worries. Only massive pump-priming through
well-targeted government spending can protect jobs and living standards
and stimulate an eventual recovery. Take a lesson from the Wall Street
bailout, adds Blackwelder; a climate rescue plan must not reward the
same bad actors that got us into this mess. Just as the financial crisis
stems from investment firms exploiting insufficient government
regulation, so the climate crisis stems from energy corporations
blocking regulation of greenhouse gas emissions, in part by
misrepresenting the science of global warming. In his recent testimony,
Hansen declared that the CEOs of fossil energy corporations "should be
tried for high crimes against humanity and nature," adding that he
welcomed the chance to testify. In the meantime, let's at least strip
those CEOs of their de facto veto power over government policy.
Otherwise, the green revolution--our best hope against impending climate
chaos--will come late or not at all.

BEYOND THE ELECTIONS:
Strategies for peace, justice, and aloha `aina!

     Regardless of election outcomes, locally and nationally, there will be plenty of work to do come Nov. 5th and beyond. This is a reminder to temper post election highs and lows with reality that all real positive change comes from the bottom up not the top down. Ordinary people committed to a vision of peace, justice and aloha aina are the backbone of movements that ultimately determine policy changes, no matter who holds positions of power. The important thing is to never give up! Vote every day! Keep the pressure on whomever is elected.

     Despite public claims that they disagree on U.S. strategy in Iraq, Senators John McCain and Barack Obama would both keep some level of U.S. troops there on permanent bases and both want to send more American troops to Afghanistan. They both also support expanding the size of the military. They both agree that the Congress must "rebuild the military" after eight years of Bush-Cheney abuse. Where will the funds come from to do these things?

     Pentagon spending has doubled during the past eight years. By 2010 military program managers are going to be scrambling to get their expensive high-tech programs funded. There is already intense competition between the different military branches for their endless military appetites. This translates into future cuts in Social Security, Medicare, Medicaid, and what remains of the severely diminished welfare program, while the numbers of elderly, poor, hungry and homeless mount. The final shots of the war against social progress are now being fired. So not only do we face the greed and excess of Wall Street, and are paying for their mistakes, but next we will be asked to continue to fund the crumbling military empire as it collapses around us with no regard for who suffers as it falls.

     This local Hawaii Island election had virtually no talk about the need for cleaning up the military mess of unexploded ordnance and radiation from decades of training. On Hawaii Island alone there are 57 known present or former military sites totalling 250,000-acres in need of clean up. Isn't it time peace, social justice, environmental, women's, and labor organizations form coalitions for needed action? Isn't it time we mount vigorous pressure on elected officials at all levels of government to stop anti-human budget cuts? Isn't it time we demand major cuts in military spending and an end to corporate subsidies? Isn't it time to articulate a vision that calls for the conversion of the military industrial complex in order that our tax dollars be used for peaceful and sustainable food and renewable energy production - not the continued industrial production for war without end? Mortgage Backed Securities are like boxes of chocolates. Criminals on Wall Street stole a few chocolates from the boxes and replaced them with turds. Their criminal buddies at Standard & Poor rated these boxes AAA Investment Grade chocolates. These boxes were then sold all over the world to investors. Eventually somebody bites into a turd and discovers the crime. Suddenly nobody trusts American chocolates anymore worldwide.

Treasury Secretary, Hank Paulson, now wants the American taxpayers to buy up and hold all these boxes of turd-infested chocolates for $700 billion dollars until the market for turds returns to normal. Meanwhile, Hank's buddies, the Wall Street criminals who stole all the good chocolates are not being investigated, arrested, or indicted.

Testimony in support of GMO Ban

In support of Bill 361

Aloha Council members:

I am a Kurtistown farmer of fruits and vegetables, including taro and
coffee, of 28 years. I urge you to support Bill 361. I have testified at
two previous hearings on the reasons why. Let me just say that the GMO
proponents claim of "coexistence" is bogus. It's the claim of the fox
wanting to co-exist with the hens in the hen house, the shark with the
fish in the fish pond, Wall St. with Main street. The big chemical
companies pushing GMOs have much in common with the Wall St. banksters.
It's all about monopoly capitalism. It's not about feeding people. It's
about greed and making a killing. GMOs, especially food crops, put at
risk contamination and the very sustainability of food production.

As for the claim it should be allowed in the lab -- the most secure lab
in the U.S. --Fort Detrick Maryland, was the source of the deadly
anthrax contamination of Congress and other sites that took several
people's lives. If security was breached there, there is no no lab,
anywhere, that can claim security for GMOs. Once GMOs are released,
there is no recall possible. I urge you to vote based on the
precautionary principle. Support bill 361. Future generations will thank

Bailout People Who Truly Need It!*

"This current financial crisis is a major way-station on the way to the
collapse of the American empire... Both major parties are rushing to get
an agreement to spend $700 billion of taxpayers' money to pour down the
drain of huge financial institutions which are notable for two
characteristics: incompetence and greed.

There is a much better solution to the current financial crisis. But it
requires discarding what has been conventional "wisdom" for too long:
that government intervention in the economy ("big government") must be
avoided like the plague, because the "free market" will guide the
economy towards growth and justice. Let's face a historical truth: we
have never had a "free market", we have always had government
intervention in the economy, and indeed that intervention has been
welcomed by the captains of finance and industry. They had no quarrel
with "big government" when it served their needs...

The rationale for taking $700 billion from the taxpayers to subsidize
huge financial institutions is that somehow that wealth will trickle
down to the people who need it. This has never worked.

The alternative is simple and powerful. Take that huge sum of money and
give it directly to the people who need it. Let the government declare a
moratorium on foreclosures and give aid to homeowners to help them pay
off their mortgages. Create a federal jobs program to guarantee work to
people who want and need jobs and for whom "the free market" has not
come through.

We have a historic and successful precedent. Roosevelt's New Deal put
millions of people to work, rebuilding the nation's infrastructure, and,
defying the cries of "socialism", established social security. That can
be carried further, with "health security" - free health care - for all.

All that will take more than $700 billion. But the money is there. In
the $600 billion for the military budget, once we decide we will no
longer be a war-making nation. And in the swollen bank accounts of the
super-rich, by taxing vigorously both their income and their wealth.
When the cry goes up, whether from Republicans or Democrats, that this
must not be done because it is "big government", the citizenry should
just laugh. And then agitate and organize on behalf of what the
Declaration of Independence promised: that it is the responsibility of
government to ensure the equal right of all to "life, liberty, and the
pursuit of happiness".

Only such a bold approach can save the nation - not as an empire, but as

Testimony supporting Bill 361

Aloha Council members:

I am an organic taro farmer. I have been farming in Kurtistown for 28 years and growing taro in Hawaii for more than 35 years. At our Malu `Aina farm we have more than 20 varieties of taro. I presented oral and written testimony in support of Bill 361 on Sept. 9, 2008. No need to repeat what I said then. But I do wish to add a few points.

1. Genetically Modified Organisms (GMOs) should be viewed as dangerous invasive species that pose great risks and threaten sustainable agriculture in Hawaii and around the world.

2. We need legislation and regulation at all levels of goverment to control this threat.

Bill 361 to protect the taro and coffee is a first step. But it is not enough.

3. Hawaii is ground zero for the GMO corporations. Our people and aina are being treated as lab rats by the new global biotech plantation industry. We are expendable.

It was a lack of government legislation and regulation that allowed the greed and corruption on Wall Street to grow like a cancer that now threatens global financial collapse. And if allowed to similarly go unregulated, unchecked, GMOs, instead of preserving food crops, may end up destroying food sustainability for the planet. GMOs are a crap shoot for corportate profit and gain, and concentrating power and control of food production. GMOs have nothing to do with feeding hungry people. Like Wall Street, it's all about privatizing profits, and socializing the risks and loss. In my judgement, that's the terrorism we need to be addressing.

Take a stand for the life of the land. Protect the coffee and the kalo. It's a start.

REFLECTIONS ON 9-11

"There are several ways to look at 9-11:

* 9-11 was planned and executed by the US government.

* BushCo did not plan 9-11, but they knew it was going to happen and did nothing to prevent it and, in fact, may have allowed it to happen.

* 9-11 was planned and executed by a group of 17 terrorists (14 of them from Saudi Arabia) without the fore knowledge of the US government and we were attacked because the terrorists 'hated our freedoms and democracy.'

"Whichever of the theories is true, one thing is for sure: the Bush regime's response to 9-11 was woefully inept and criminal and many people have been killed, wounded, displaced or destroyed because of the Bush regimes' exploitation of the tragedy to use ultra-violence against the innocent people of two nations in response to a criminal act perpetrated by a few. ...

Instead of taking a hard and critical look at the corporate-imperialistic policies of our government and trying to objectively figure out why we were attacked, we set off on a nationalistic flag waving fervor of mass fear that was only to be cured by shopping, traveling and allowing George and Dick to make a demented response to it. After 9-11 our country lost a real opportunity to search our souls and make amends to the world for our greed and violence. An apt response would have been to punish the perpetrators of the crime in a court of law and not by rabidly seeking the first country to destroy. ...

Our famous 'freedoms' that the terrorists 'hated' have been eroded ... We can be guaranteed that any call, email or text message that we send or receive is being read and if we dare protest we will be pepper-sprayed, maced, tear gassed, tasered, or beaten with a Billy club by our employees: law enforcement; authorized by our other employees: government. ...

It's not only time for new leadership in our government, but it's time for a new 9-11 Commission that has subpoena power and is not facilitated by the crooks who either perpetrated the crime and/or collaborated with it. Government abuses cannot be credibly investigated by government commissions: A citizen's investigation that is independent from the federal government and where people like George and Dick will actually have to give their testimony in the light of day, under oath and not holding hands, must be empowered and empanelled. ... Our deepest condolences to those who lost family member on 9-11 and anyone else on this planet who have lost their jobs, homes, or lives due to George's tragic response to the tragedy of 9-11."

The Prophetic Challenge:

"Few Are Guilty, but All Are Responsible"

"One of the common refrains I heard from progressive people in Pakistan and India during my month there this summer was, "We love the American people - it's the policies of your government we don't like." That sentiment is not unusual in the developing world, and such statements can reduce the tension with some Americans when people criticize U.S. policy, which is more common than ever after the illegal invasions and occupations of Afghanistan and Iraq.

I used to smile and nod when I heard it, but this summer I stopped agreeing... It is long past time that we the people of the United States started holding ourselves responsible for the crimes our government perpetrates around the world.

This is our prophetic challenge, in the tradition of the best of the prophets of the past, who had the courage to name the injustice in a society and demand a reckoning. In the Christian and Jewish traditions, the Old Testament offers us many models - Amos and Hosea, Jeremiah and Isaiah. The prophets condemned corrupt leaders but also called out all those privileged people in society who had turned from the demands of justice that the faith makes central to human life. In his study of The Prophets, the scholar and activist Rabbi Abraham Joshua Heschel concluded: "Above all, the prophets remind us of the moral state of a people: Few are guilty, but all are responsible..."

This is our fate living in the empire. We must hold ourselves and each other accountable, while knowing that the powerful systems in place are not going to change overnight simply because we have good arguments and are well-intentioned. We must ask ourselves why we don't do more, while recognizing that none of us can ever do enough. We must be harsh on ourselves and each other, while retaining a loving connection to self and others, for without that love there is no hope.

People often say this kind of individual and collective self-assessment is too hard, too depressing. Perhaps, but it is the path we must walk if we wish to hold onto our humanity... If we wish to find our prophetic voice, we must have the courage to speak about the crimes of our leaders and also look at ourselves honestly in the mirror. That requires not just courage but humility. It is in that balance of a righteous anger and rigorous self-reflection that we find not just the strength to go on fighting but also the reason to go on living."

The Past Destroyed: Five Years Later

On April 11, 12, 13, and 14, 2003, the United States Army and United States Marine Corps disgraced themselves and the country they represent in Baghdad, Iraq's capital city. Having invaded Iraq and accepted the status of a military occupying power, they sat in their tanks and Humvees, watching as unarmed civilians looted the Iraqi National Museum and burned down the Iraqi National Library and Archives as well as the Library of Korans of the Ministry of Religious Endowments. Their behavior was in violation of their orders, international law, and the civilized values of the United States. Far from apologizing for these atrocities or attempting to make amends, the United States government has in the past five years added insult to injury...

In 2006, the World Monuments Fund took the unprecedented step of putting the entire country of Iraq on its list of the most endangered sites. All of this occurred on George W. Bush's watch and impugned any moral authority he might have claimed.

The United States government seems never to have understood that, when it began the occupation of Iraq on March 19, 2003, it became legally responsible for what happened to the country's cultural inheritance... Picket to begin 4:30PM Tuesday, Aug. 19th fronting the Naniloa Hotel on Banyan Drive in Hilo.

It's a Mayoral forum, but only the top 4 money collectors of 8 candidates have been invited to particiapte. The Hawaii County Bar Association is the sponsoring organization. Shame on them! The principle issue is that all candidates for Mayor should be welcome. The forum is free and open to the public so maybe there will be an opportunity to raise a question or two or make a statement. The 4 candidates inside should be asked their position on excluding the other 4.

The picket is not about supporting a particlar candadate. It's about fairness in the democratic process, not money, determining an election. Come join the picket. Pass the word. Make a sign.

The Bush administration is using the election as a cover, as it increases threats against Iran. It has quietly assembled the largest naval armada in one place since World War II - in the Persian Gulf, with guns aimed at Iran. In addition they have now deployed 18 NATO ships to the Black Sea and raised threats against Russia. Meanwhile, no troops have been withdrawn from the disastrous wars in Iraq & Afghanistan. And now the U.S. is firing missiles into Pakistan.

There are always billions of dollars for war and billions more to bail out the big banks and mortgage companies, but no assistance for the 600,000 working people laid off this year, or the 2 million small homeowners being foreclosed in record numbers, or the more the 50 million people without health care.

We need money for jobs, housing, transportation, and food to feed our families -- not for another war! While the situation is growing dire for many, Washington's cutbacks in domestic programs continue. The fiscal year beginning on October 1 will bring drastic cuts. A new U.S. war will bring only more suffering here as well as massive destruction abroad.

We, the people, must take action now! Real change for justice and peace won't come from the top down. History shows it must come from the ground up. Do your part!

Massive US Naval Armada Heads For Iran!

Operation Brimstone ended only one week ago. This was the joint US/UK/French naval war games in the Atlantic Ocean preparing for a naval blockade of Iran and the likely resulting war in the Persian Gulf area. The massive war games included a US Navy supercarrier battle group, an US Navy expeditionary carrier battle group, a Royal Navy carrier battle group, a French nuclear hunter-killer submarine plus a large number of US Navy cruisers, destroyers and frigates playing the "enemy force"...

The build up of naval forces in the Gulf will be one of the largest multi-national naval armadas since the First and Second Gulf Wars. The intent is to create a US/EU naval blockade (which is an Act of War under international law) around Iran (with supporting air and land elements) to prevent the shipment of benzene and certain other refined oil products headed to Iranian ports. Iran has limited domestic oil refining capacity and imports 40% of its benzene. Cutting off benzene and other key products would cripple the Iranian economy. The neo-cons are counting on such a blockade launching a war with Iran.

Ron Paul (R-Tex.) has warned millions of radio listeners that the United States is heading into an illegal attack on Iran, stating his amazement at members of Congress who have openly voiced support for a criminal nuclear strike. CODEPINK Peace Activists Present

Our Journey for Peace with Iran

Peace activists Leslie Angeline and Jes Richardson traveled to Iran last year as part of a Global Exchange 'Citizen Diplomacy Delegation'. This experience motivated them to quit their jobs and travel to Washington DC to lobby Congress full-time for Peace with Iran.

After their trip to Iran, Leslie went on a hunger strike to pressure Senator Lieberman to talk with her about his call for the use of military force against Iran. Leslie is an active member of CODEPINK - Women for Peace and has participated in many significant actions.

Jes and Leslie fell in love with the Iranian people and found them to be warm, sophisticated and incredibly generous. They also learned that seventy percent of the population is under the age of 30. They filmed their journey in Iran and have a great collection of footage and photographs. Our Journey for Peace with Iran presentation will include these wonderful images and stories of the couple's CODEPINK activism in Washington DC and around the country.
